HB2465 removes the option of a secret ballot election by requiring recognition of unions as bargaining units on the basis of authorization cards signed by a majority of employees. This bill raises concerns about possible unlawful interference and inappropriate peer pressure in the union process, especially considering that the process will essentially be left "open" for twelve months. Moreover, it creates preemption issues with the federal model under the National Labor Relations act (NLRA) of 1935, which was recently upheld when a Congressional bill with similar goals as this state bill failed to move forward in the Senate. HB2465 passed the House and the Senate with some business-friendly amendments to lesson its impact on the private sector and signed by the Governor on September 27, 2007. Even with the slightly improved amended version this law creates unnecessary changes to a process that currently works, allows privacy and is in line with federal regulations.
